Need Opinion on Porch Foundation

We need some help. We have hired a builder for new home construction in Western KS. We have a worry about our porch foundation. Our basement had a 3' over dig and the porch spans that area. Where there was over dig, it settled tremendously and there is a void under the patio. Naturally I am very worried that the porch is going to settle over time and cause sever structural damage. In fact, there is already a crack forming in the porch cap. There were 3' footings dug down for the entire porch perimeter so almost all of that sits on undisturbed soil except the 3' that spans the over-dig. Furthermore, the builder stacked cinder blocks up next to the basement foundation so the porch footer sits on those as well. The porch is about 10' deep and 16' long. Can anyone please look at our pictures and project and tell me if we have a problem? Our builder says no. Our city inspector says yes. Is the footing tied into the basement wall with rebar? Is that footing really below frost depth (once soil is put back)?

I believe it is below frost line, but not 100% sure its tied into basement with rebar. They poured them separately....the porch footings were added later.
